These cases are so prevailent these days, and the punishments so varying, it's confusing anymore.</span>

WISE ? Commonwealth's Attorney Ron Elkins said the 13-year-old boy who was involved with a former Powell Valley High School teacher's aide was instrumental in the woman's sentence this week in Wise County Circuit Court.

"It's very rare your victim gets to pick the punishment," Elkins said.

But it was the victim's agreement with a plea deal for Darlene Blagg that kept her from the possible maximum 15-year sentence she faced.

Blagg, 36, of 2200-D Eagan Road, Big Stone Gap, Va., pleaded guilty Wednesday in Wise County Circuit Court to three felony sexual misconduct counts in exchange for a suspended three-year prison term.

Blagg's jail time was suspended except for 30 days she must serve. She is scheduled to report to jail June 15, Elkins said.

In addition to the jail term, Blagg is prevented from working with children, must serve two years of supervised probation and one year of unsupervised probation and is required to register as a sex offender.

Blagg was arrested in March after a Wise County grand jury indicted her on nine counts of indecent liberties with a juvenile by a person in a supervisory position.

The charges stem from Blagg's admission she had sex with a Powell Valley High student.

The boy's mother discovered the relationship when she found several text messages on his cell phone that were of a sexual nature.

Blagg worked part time for the school district as a student aide, school system officials said. She was not assigned to the teen with whom she had the relationship, officials said at the time.

She was terminated from the school district after the investigation began.

Elkins said he was satisfied with the agreement.
